1. Scope

These General Terms and Conditions (hereinafter “GTC”) apply to all contracts between Felix Schweizer, operating under the brand FEDJA Music (hereinafter “FEDJA Music”), and the client regarding DJ services, equipment rental and related services. Differing terms of the client shall only apply if they have been confirmed in writing.

2. Conclusion of contract

Offers from FEDJA Music are non-binding. The contract is concluded upon written confirmation of the offer by the client and receipt of the deposit pursuant to clause 4. Confirmation may be made by e-mail, countersigned PDF or online form.

3. Services

The scope of services results from the specific offer. Generally included are: musical programme, advance consultation, delivery, set-up and dismantling of the agreed equipment as well as the performance within the defined time slot. Not included are catering for the DJ at the venue, accommodation for distances over 80 km from Zurich, as well as official permits.

4. Prices and payment terms

Prices stated in the offer are in Swiss Francs. The VAT status is noted in the offer.

A deposit of 50% of the order volume is due within 10 days of conclusion of the contract and secures the reservation of the date. The remaining amount must be received in the account specified in the offer no later than 7 days before the event date. The date of receipt of payment is decisive.

In the event of late payment, FEDJA Music may refuse performance without any claims arising for the client.

5. Cancellation by the client

If the client withdraws from the contract, the following cancellation fees apply, calculated on the total volume of the offer:

Deposits already paid are credited towards the cancellation fee, not charged additionally. The receipt of the written cancellation by FEDJA Music is decisive.

6. Postponement and force majeure

In cases of force majeure – in particular official orders, pandemics, natural events or comparable circumstances that make the event impossible – the date will be postponed once free of charge within 12 months from the original date. Deposits already paid remain in place and are credited to the replacement date.

If no agreement on a replacement date is reached, the cancellation provisions according to clause 5 apply.

7. Inability of the DJ to perform

If FEDJA Music is prevented from performing due to illness, accident or other unforeseeable reasons, FEDJA Music will, where possible, arrange a qualified replacement DJ from its own network on the same conditions. If no replacement can be provided, the deposit will be refunded in full. Further claims by the client are excluded as far as legally permissible.

8. Obligations of the client

The client ensures that the following requirements are met at the venue:

If the client does not meet these requirements and additional effort arises as a result (e.g. longer carrying distances, additional equipment), this can be charged additionally based on actual effort.

9. Set-up and dismantling

Set-up takes place by arrangement, generally from 2 hours before the event start. Dismantling takes place immediately after the end of the performance, unless otherwise agreed. Set-up and dismantling times are not part of the booked performance time.

10. Extension of the performance

Extensions beyond the agreed performance time are charged at CHF 300 per started hour and must be approved on site in writing (e-mail, SMS, signed form).

11. Noise protection and official requirements

Obtaining all official permits as well as compliance with local noise protection, curfew and safety regulations is the responsibility of the client. FEDJA Music will follow the client’s instructions, but assumes no liability for violations resulting from insufficient information or missing permits.

12. Liability

FEDJA Music is liable for damages caused by FEDJA Music or its equipment within the scope of the existing professional liability insurance. Liability for slight negligence, indirect damages, lost profits or consequential damages is excluded as far as legally permissible.

Damage to equipment caused by guests or third parties is borne by the client. The client is liable for theft or loss during the event, unless caused by FEDJA Music. The client is obliged to protect the equipment with reasonable care during the event.

13. Image and audio recordings

FEDJA Music is entitled to make and use image and audio recordings at the venue for its own marketing and reference purposes (website, social media, showreel, portfolio). Commercial transfer to third parties (e.g. for advertising campaigns or stock material) only takes place with the prior written consent of the client.

The client may object to the making of recordings in writing at any time – at the latest upon conclusion of the contract. In that case, work will be carried out without recordings.

14. Data protection

FEDJA Music processes personal data exclusively for the purpose of contract execution and within the framework of the Swiss Data Protection Act (FADP). Data is not passed on to third parties, except to service providers necessary for contract performance (e.g. trustee, accounting). 15. Written form and amendments

Amendments and additions to this contract require written form. The written form is also fulfilled by e-mail correspondence. There are no oral side agreements.

16. Severability clause

Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose.

17. Applicable law and jurisdiction

Swiss law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Zurich.
